WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANSWER KEY SYSTEMS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, or business opportunities
  • Any damages arising from your use or inability to use the Service

Our total liability for any claim arising from these terms shall not exceed the amount you paid us, if any, during the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless Answer Key Systems, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) your content uploaded to the Service.

You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your account data after a reasonable period.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Delaware for the resolution of any disputes.

12. Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

  • We encourage you to first contact us directly to seek a resolution
  • If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration
  • Arbitration shall be conducted in accordance with the rules of the American Arbitration Association
  • You agree to waive any right to participate in a class action lawsuit or class-wide arbitration

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Answer Key Systems regarding your use of the Service. Any prior agreements, representations, or understandings are superseded by these Terms.

15. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of any material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new terms.
